| Tradehop.com and myTradeBuyer.com- both B2B portal where tradehop.com supports listing Suppliers Information where as mytradebuyer.com provides Selling & buying offers. These two are common platform and part of MATH 2S Technology. This Agreement explains our obligations to you, and explains your obligations to us for tradehop.com & mytradebuyer.com. By using our service(s) you agree to establish an account with us for such services. This Agreement will become effective after you / we have setup your tradehop.com & mytradebuyer.com account. DEFINITION As used in this terms and conditions, the following terms have the following meanings respectively. Words given in the singular also may be construed in their plural sense or vice versa if the context so requires. tradehop.com & mytradebuyer.com means the site owned by MATH 2S Technology. "We" or "Us" or "Our" means tradehop.com & mytradebuyer.com and/or MATH 2S Technology as described in above line. "You" and/or "users" means any individual or business entity that is using this site. USERS Our services are provided to individuals or companies who can form legally binding contracts under applicable law. If you do not qualify, please do not use the service. LINKS Our site(s) may contain links to other web sites. Since we provide those sites as a convenience to our users and do not control them, we will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such third party sites. TERMINATION & REFUND POLICY Most content and some of the features on the web site are made available to visitors free of charge. However, MATh 2S Technology reserves the right to terminate access to certain areas or features of the web site (to paying or registered users) at any time for any reason, with or without notice. If MATh 2S Technology terminates user(s) membership, user(s) will not have the right to re-enroll or join MATh 2S Technology under a new account or name unless formally invited to do so by MATh 2S Technology. In any case of termination, no membership charges will be refunded. User(s) acknowledge that inability to use the web site wholly or partially for whatever reason may have adverse effect on its business. User(s) hereby agree that in no event shall the web site be liable to the user(s) or any third parties for any inability to use the web site (whether due to disruption, limited access, changes to or termination of any features on the web site or otherwise), any delays, errors or omissions with respect to any communication or transmission, or any damage (direct, indirect, consequential or otherwise) arising from the use of or inability to use the web site or any of its features. All users shall be able to control the information sharing through their administration panel available at http://www.mytradebuyer.com/home/contact-details. Only MATh 2S Technology, its registered members or its agents working under confidentiality agreements will send these direct mailers. Relevancy of the contacts made between users would depend upon the information sought & given by various users. LIMITATION OF LIABILITY IN NO EVENT SHALL WE OR OUR AGENTS, SUPPLIERS, AND SUBCONTRACTORS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY, AND THE LIABILITY OF OUR AGENTS, SUPPLIERS, AND SUBCONTRACTORS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO. GOVERNING LAW AND DISPUTE RESOLUTION Terms and condition of use agreement and/ or Agreement, Privacy Policy shall be governed in all respect by the laws of Indian Territory . MATH 2S Technology considers itself and intended to be subject to the jurisdiction only of the Courts of Kolkata, West Bengal, India. The parties to this Agreement hereby submit to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India. NOTICES All notices or demands to or upon tradehop.com & mytradebuyer.com shall be effective if in writing and shall be duly made when sent to tradehop.com & mytradebuyer.com in the following manner: to the address of MATH 2S Technology: Legal Department. All notices or demands to or upon a User shall be effective if either delivered personally, sent by courier, certified mail, by facsimile or email to the last-known correspondence, fax or email address provided by the User to tradehop.com & mytradebuyer.com, or by posting such notice or demand on an area of the Site that is publicly accessible without a charge. Notice to a User shall be deemed to be received by such User if and when - tradehop.com & mytradebuyer.com is able to demonstrate that communication, whether in physical or electronic form, has been sent to such User, or - immediately upon posting such notice on an area of the Site that is publicly accessible without charge. |
